1. Acceptance of Terms

By accessing or using LightningEX ("the Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and LightningEX.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following any changes indicates your acceptance of the modified Terms.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age or the legal age of majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Not be a resident of or located in any jurisdiction where the use of cryptocurrency exchanges is prohibited by law
  • Not be subject to any sanctions administered by any applicable government authority

By using the Platform, you represent and warrant that you meet all of the above eligibility requirements.

3. Services Description

LightningEX provides a non-custodial cryptocurrency exchange platform that allows users to exchange one cryptocurrency for another. The Platform aggregates rates from multiple liquidity providers to offer competitive exchange rates.

Key features of our service include:

  • Instant cryptocurrency exchanges without registration
  • Support for 240+ cryptocurrencies across multiple blockchain networks
  • Real-time exchange rate quotes
  • Order tracking and status updates
  • API access for developers (where available)

4. Non-Custodial Nature

LightningEX operates as a non-custodial exchange. This means:

  • We do not hold your funds or private keys
  • All exchanges occur directly between user wallets
  • You maintain full control and responsibility for your cryptocurrency assets
  • We cannot recover funds sent to incorrect addresses

It is your responsibility to ensure that you provide accurate wallet addresses and network information when creating an exchange order.

5. Exchange Process

When you initiate an exchange on the Platform:

  • You will receive a quote valid for a limited time period
  • You must send the exact amount specified to the provided deposit address
  • Deposits must be made within the specified time limit (typically 1 hour)
  • The exchange rate is locked once your deposit is confirmed
  • Funds will be sent to your specified receiving address upon completion

Failure to follow these procedures may result in delayed, failed, or lost exchanges.

6. Fees

LightningEX charges fees for exchange services, which include:

  • A service fee included in the exchange rate (typically 0.1% - 0.5%)
  • Network fees (miner/gas fees) required by the respective blockchains

All fees are disclosed before you confirm an exchange. The amount displayed as "You Receive" is the net amount after all fees.

7. Prohibited Activities

You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Platform. Specifically, you may not:

  • Use the Platform for money laundering, terrorist financing, or other illegal activities
  • Attempt to gain unauthorized access to any portion of the Platform
  • Use automated systems or software to extract data from the Platform
  • Circumvent any security measures or rate limits
  • Provide false or misleading information
  • Use the Platform if you are subject to any applicable sanctions

8. Risk Disclosure

Cryptocurrency exchanges involve significant risks, including but not limited to:

  • Price volatility and market fluctuations
  • Technical failures or blockchain network issues
  • Regulatory changes affecting cryptocurrency use
  • Potential loss of funds due to user error
  • Smart contract vulnerabilities

You acknowledge that you understand these risks and agree to use the Platform at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, LightningEX and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform.

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the transaction giving rise to the claim.
